تدير Songlorious, LLC («Songlorious» أو «نحن») الموقع www.songlorious.com وما يتصل به من صفحات وحسابات وخدمات، ومنها هذه الصفحات العربية (ويُشار إليها جميعًا بـ«الموقع»). شروط الاستخدام هذه، بما فيها ما تذكره عن خصوصيتك (القسم 14)، مع الأسئلة الشائعة (ويُشار إليها جميعًا بـ«الشروط»)، هي الاتفاق بينك وبيننا. وباستخدامك الموقع أو تقديمك طلبًا فإنك تقبلها. وإن لم توافق عليها، فالرجاء عدم استخدام الموقع.

وحيث تصف الأسئلة الشائعة وهذه الشروط الأمر نفسه بشكل مختلف، فهذه الشروط هي المعتمدة.

تسري هذه الشروط العربية على الطلبات المقدّمة من صفحاتنا العربية. وفي ما لا تتناوله، تُطبَّق شروط الاستخدام الإنجليزية المنشورة على موقعنا بما لا يتعارض معها.

قد نحدّث هذه الشروط من وقت لآخر. وتجد النسخة الحالية دائمًا على www.songlorious.com/arabic/terms-arabic، وتاريخ سريانها أعلى الصفحة. ويسري على كل طلب ما كان معمولًا به من الشروط وقت تقديمه. واستمرارك في استخدام الموقع بعد أي تغيير يعني قبولك الشروط المحدَّثة.

في Songlorious يقود العملَ فنانون وأشخاص حقيقيون، وتساندهم التقنية. عندما تطلب أغنية تخبرنا بالقصة والأشخاص والتفاصيل التي لا بد منها والأسلوب والطابع والصوت الذي تفضّله، وبعدها:

• يكتب فريقنا العربي كلمات أغنيتك من التفاصيل التي تعطينا إياها، ثم يرسلها إليك بالبريد الإلكتروني أو على واتساب لتراجعها قبل تسجيل أي شيء (القسم 6).
• يصنع منتجونا الموسيقى بأدوات إنتاج احترافية، منها تقنيات موسيقية تستعين بالذكاء الاصطناعي. ويوجّه شخص حقيقي كل أغنية ويراجعها ويحرّرها ويُتمّها.
• الصوت في أغنيتك مبني على صوت مطرب حقيقي من كتالوج فنانينا، وافق على العمل معنا ويتقاضى أجرًا على ذلك. ويُطبَّق صوته على أغنيتك ضمن عملية الإنتاج لدينا (القسم 13).
• يمزج منتج حقيقي التسجيل النهائي ويُتقنه يدويًا قبل أن يصلك.

لا نبيع نتائج ذكاء اصطناعي بضغطة زر، ولا نقول إن المطرب الذي اخترته دخل الاستوديو بنفسه وسجّل أغنيتك. فكلا الأمرين غير صحيح، وهذا القسم موجود لتعرف تمامًا ما الذي تشتريه.

يجب أن يكون عمرك 18 عامًا على الأقل لتقديم طلب. وحسابك مرتبط بالبريد الإلكتروني الذي تطلب به، فاحرص على صحته، لأننا نرسل إليه كلمات أغنيتك وأغنيتك وكل إشعار يخص طلبك (وقد نرسل إليك الكلمات وتحديثات الطلب على واتساب أيضًا). وأنت مسؤول عن أي نشاط يجري من خلال حسابك.

يجوز لنا رفض أي طلب أو إلغاؤه، أو إغلاق أي حساب، عند مخالفة هذه الشروط أو حين نعتقد لأسباب معقولة أن الطلب احتيالي أو مسيء. وإن رفضنا طلبًا قبل بدء العمل عليه، نعيد قيمته كاملة.

ما تعطينا إياه

الطلب هو التفاصيل التي تكتبها في صفحة الطلب: قصتك، والأشخاص المعنيّون، وتفاصيلك الأربعة التي لا بد منها، والمناسبة، واللهجة والأسلوب، والطابع، والمدة، وسرعة التسليم، والصوت. نصنع الأغنية من هذه التفاصيل، فاحرص على أن تكون دقيقة وكاملة. ولسنا مسؤولين عن أغنية تعكس بأمانة تفاصيل أعطيتنا إياها بشكل خاطئ.

تغيير تفاصيلك بعد الطلب

بعد الطلب، لديك مهلة تضيف فيها إلى أيٍّ من تفاصيلك أو تغيّره من صفحة أغنيتك (زر «Edit My Order»). وتعتمد المهلة على سرعة التسليم التي اخترتها:

ويمكنك إنهاء المهلة مبكرًا بتأكيد أن تفاصيلك نهائية (زر «These details are final — start my song»)، فيبدأ العمل على أغنيتك أسرع. وحين تنتهي المهلة، أو تؤكد تفاصيلك، نبدأ الكتابة ولا يعود بالإمكان تغيير تفاصيلك. وفرصتك التالية لتغيير أي شيء هي مراجعة الكلمات (القسم 6).

تاريخ التسليم

تختار تاريخ التسليم عند الطلب، ونسلّم أغنيتك بحلول الساعة 11:59 مساءً بتوقيت شرق الولايات المتحدة في ذلك التاريخ (أي صباح اليوم التالي بتوقيت الخليج). وللتسليم الأسرع الرسوم الظاهرة عند الدفع.

الأسعار والدفع

تظهر الأسعار عند الدفع بالدولار الأمريكي، وهي شاملة لكل ما يتعلق بالخيارات التي تختارها. وأي مبلغ بالريال السعودي نعرضه بجانبها تقريبي وللتوضيح فقط، والمبلغ المحتسب هو المبلغ بالدولار. ويُدفع المبلغ عند الطلب (أو على دفعتين في خيار «جرّب قبل أن تشتري»، كما في القسم 7). وتعالج المدفوعات جهات دفع خارجية وفق شروطها، ولا نحفظ بيانات بطاقتك كاملة.

الكلمات التي نكتبها لك

يكتب فريقنا العربي كلمات أغنيتك من قصتك، ثم يرسلها إليك بالبريد الإلكتروني أو على واتساب لتراجعها وتطلب أي تعديل قبل التسجيل. يمكنك أن تعيد صياغة أي سطر تريده، وعدد ما تشاء من الأسطر، دون أي تكلفة. ويجب أن يبقى كل سطر قريبًا من طوله الأصلي ليظل مناسبًا للّحن، وإن غيّرت سطرًا يتكرر في اللازمة فسنسألك أتريد تغييره في كل المواضع أم في موضع واحد فقط.

اعتمادك للكلمات نهائي. حين تعتمد الكلمات، أو حين يبدأ التسجيل، تذهب الكلمات كما هي في تلك اللحظة إلى الإنتاج كما كُتبت تمامًا، ولا يمكن تغييرها مرة أخرى قبل التسليم. نرسل إليك الكلمات في وقت يسمح بتسليم أغنيتك في موعدها. وإن لم تصلنا ملاحظاتك قبل بدء التسجيل، نسجّل الأغنية بالكلمات التي أرسلناها إليك.

الكلمات التي تكتبها بنفسك

يمكنك أن تقدّم كلماتك الخاصة عند الطلب، ونسجّل أغنيتك بها كما كتبتها. وإن فعلت ذلك، فأنت تؤكد أنك كتبتها، وأنك تملكها، وأنها لا تنسخ كلمات أحد أو لحنه أو أغنيته ولا تقتبس منها. لا يمكننا صنع أغاني مُعادة أو محاكاة ساخرة أو أغاني مبنية على أعمال موجودة، ومن ذلك إعادة تسجيل زفّة أو أغنية معروفة بإضافة الأسماء إليها. ويجوز لنا رفض الكلمات المقدّمة أو تعديلها إن بدا أنها تنتهك حقوق غيرك، أو تتجاوز ما تتسع له مدة الأغنية (دقيقتان: 1,800 حرف، و3 دقائق: 2,400 حرف، و4 دقائق: 3,000 حرف، و5 دقائق: 3,600 حرف، و6 دقائق: 4,200 حرف، مع احتساب المسافات وفواصل الأسطر؛ ومدد الأغاني تقريبية)، أو تخالف القسم 15. والكلمات التي تقدّمها تبقى ملكك، وتمنحنا ترخيصًا بها كما في القسم 14.

مع خيار «جرّب قبل أن تشتري» تدفع 50% من سعر الأغنية عند الطلب، ونصنع أغنيتك كاملة. وحين تجهز تحصل على الكلمات كاملة ومقطع من أغنيتك (نحو 30 ثانية) في صفحة أغنيتك، ثم يمكنك فتح الأغنية كاملة بسداد المبلغ المتبقي.

• الدفعة الأولى غير قابلة للاسترداد، لأنها تغطي الكتابة والإنتاج اللذين تمّا بالفعل.
• إن وجدت في المقطع ما لا يطابق طلبك، فاستخدم خيار الإبلاغ عن مشكلة في الأغنية («Something’s wrong with this song») في صفحة أغنيتك. نصلحه مجانًا، ولا تحتاج إلى سداد المبلغ المتبقي أولًا.
• وإن أردت شيئًا مختلفًا فحسب، فذلك تعديل (القسم 9): اعتمد أغنيتك، وادفع المبلغ المتبقي، واطلب التعديل خلال 72 ساعة من تسليم الأغنية كاملة.
• الإضافات التي تشتريها مع طلب «جرّب قبل أن تشتري» تُنفَّذ بعد سداد المبلغ المتبقي.

تصلك أغنيتك على صفحتها في الموقع (وهي باللغة الإنجليزية حاليًا)، مع رسالة بالبريد الإلكتروني لإبلاغك. وفيها يمكنك الاستماع إلى أغنيتك وقراءة كلماتها وتنزيلها بصيغة MP3 كلما أردت. وننوي إبقاء صفحة أغنيتك متاحة، لكننا ننصحك بتنزيل نسختك والاحتفاظ بها، فلا نضمن بقاء أي ملف على الموقع إلى أجل غير محدود.

ملفات المشروع القابلة للتعديل التي صُنعت منها أغنيتك كبيرة الحجم، ولا نحتفظ بها طويلًا بعد التسليم، ولهذا للتعديلات موعد نهائي (القسم 9).

ما نعدك به

كل أغنية نسلّمها:

• تكون تسجيلًا جيد الجودة (دون خلل، أو دخول أو انقطاع مفاجئ للصوت، أو تشويش غير مقصود، أو صوت منخفض أكثر من اللازم)؛
• تفي بالمدة التي طلبتها؛
• يكون غناؤها مضبوط النغمة؛
• تتضمن تفاصيلك الأربعة التي لا بد منها وتعبّر عن قصتك بدقة، كما كتبتها في طلبك وكما اعتمدتها عند مراجعة الكلمات.

الإصلاح المجاني

إن لم تفِ أغنيتك بهذا الوعد، فذلك خطؤنا. أخبرنا خلال 72 ساعة من التسليم عبر طلب التعديل في صفحة أغنيتك، ونصلحه دون مقابل. وفي خيار «جرّب قبل أن تشتري» تبدأ الساعات الـ72 من سداد المبلغ المتبقي وتسليم الأغنية كاملة، أما مشكلات المقطع فتُعالَج وفق القسم 7.

كل ما عدا ذلك تعديل

أي تغيير آخر بعد التسليم تعديلٌ: إحساس أو إيقاع أو توزيع أو آلات مختلفة، أو صياغة مختلفة عن الكلمات التي اعتمدتها، أو صوت آخر، أو أي شيء مبنيّ على الذوق لا على ما طُلب. وللتعديلات رسوم تعتمد على حجم العمل. نراجع طلبك، ونخبرك بالتكلفة قبل أن نفعل أي شيء، ثم نرسل إليك فاتورة منفصلة. ولا توجد حصة مجانية للتغييرات «الصغيرة»، لأن تغيير بضع كلمات يعني إعادة إنتاج الأغنية.

يجب طلب التعديلات خلال 72 ساعة من التسليم، فبعدها قد لا نتمكن من إجراء أي تغيير، لأننا لا نحتفظ بملفات المشروع (القسم 8). والتعديلات على أغنية نُشرت بالفعل على منصات البث لا تشمل إعادة نشرها؛ راجع القسم 11.

كل أغنية تُصنع لك خصيصًا ولا يمكن إعادة استخدامها لغيرك، لذلك لا نردّ قيمة الطلب بعد بدء العمل عليه.

• إلغاء طلب مدفوع بالكامل: يمكنك إلغاؤه خلال 24 ساعة من تقديمه، ونعيد لك المبلغ بعد خصم 35% منه رسومًا للخدمة والمعالجة.
• «جرّب قبل أن تشتري»: الدفعة الأولى غير قابلة للاسترداد (القسم 7).
• الطلبات التي نرفضها قبل بدء العمل نعيد قيمتها كاملة (القسم 4).

الموسيقى أمر شخصي، وأحيانًا لا تأتي الأغنية كما تمنّيت رغم أنها تفي بكل ما وعدنا به. نتعامل مع هذه الحالات كلًّا على حدة، فتحدّث معنا.

ترخيص الاستخدام التجاري

ترخيصك العادي للأغنية مخصّص للاستخدام الشخصي (القسم 12). ويلزمك «ترخيص الاستخدام التجاري» إن كنت تشتري الأغنية لعلامة تجارية أو نشاط تجاري، أو ستستخدمها للترويج لأي منهما، أو ستشغّلها أو تؤدّيها في فعالية عامة أو فعالية لنشاط تجاري، أو ستنشرها على حساب تجاري أو حساب علامة تجارية أو حساب مؤثّر. وتشمل العلامات التجارية العلامات الشخصية والمنظمات غير الربحية. وإن تبيّن من محتوى الأغنية أنها تحتاج إلى ترخيص تجاري لم يُشترَ، نرسل إليك فاتورته ونوقف الطلب مؤقتًا حتى تسدّدها. واستخدام الأغنية في غير الاستخدام الشخصي دون ترخيص تجاري مخالفة لهذه الشروط.

نشر الأغنية على منصات البث

مع إضافة «نشر الأغنية على منصات البث» نوزّع أغنيتك على منصات البث الكبرى، عادةً خلال نحو 10 أيام من التسليم، باسم المطرب. ونتحكم نحن في بياناتها الوصفية وصورتها وإصدارها وأي حذف لاحق لها، وقد لا تتوفر على المنصات في بعض الدول. وتحتفظ Songlorious بأي عائدات من البث، ولا تحصل أنت على أي عائدات. والنشر على منصات البث يجعل أغنيتك علنية، فلا تختره لأغنية فيها تفاصيل تفضّل أن تبقى خاصة.

ترخيصك

عندما تُسلَّم أغنيتك ويُدفع ثمنها كاملًا، نمنحك ترخيصًا دائمًا وعالميًا وغير حصري ودون إتاوات، لتشغيل أغنيتك وتنزيلها ونسخها لاستخدامك الخاص ومشاركتها لأغراض شخصية غير تجارية: الاستماع إليها في خصوصيتك، ومشاركتها مع الأصدقاء والعائلة، ونشرها على حساباتك الشخصية (غير التجارية) في وسائل التواصل الاجتماعي، وتشغيلها في مناسبات خاصة لا تحمل علامة تجارية، مثل حفل زفاف أو عيد ميلاد. ولا يحق لك بيع الأغنية أو ترخيصها أو ترخيصها من الباطن أو تأجيرها أو توزيعها، ولا استخدامها للترويج لأي شيء، ولا استخدامها في أي سياق تجاري أو عام، دون ترخيص تجاري.

ويمدّ الترخيص التجاري هذا الترخيص ليشمل الاستخدامات التجارية والعامة للأغنية كما سُلّمت. ولا يشمل الحق في إعادة بيع الأغنية نفسها، ولا تسجيلها عملًا موسيقيًا باسمك، ولا حذف اسم المطرب أو تغييره حيث يظهر.

ما نحتفظ به، وما يمكننا أن نعد به بصدق

تحتفظ Songlorious بملكية التسجيل الصوتي وبكل الحقوق في الأغنية، عدا ما رخّصناه لك أعلاه وأي كلمات قدّمتها بنفسك. ولا نرخّص لك إلا الحقوق التي نملكها فعلًا.

ولأن عملية الإنتاج لدينا تستعين بتقنيات موسيقية تعتمد على الذكاء الاصطناعي، فقد لا تكون بعض العناصر الموسيقية في أغنيتك قابلة للحماية بحقوق النشر وفق القانون الحالي، ولا نعد بأن اللحن أو التوزيع أو التسجيل الصوتي قابل لتسجيل حقوقه رسميًا أو فريد أو خالٍ من التشابه مع موسيقى أخرى. ما نعد به هو أن الكلمات كُتبت لك، وأن الأغنية أُنتجت لك، وأن أحدًا غيرك من العملاء لن يحصل على أغنيتك.

يجوز لـ Songlorious استخدام أغنيتك ومقاطع منها للتعريف بـ Songlorious وبفنانينا، مثل عرضها نموذجًا أو في الإعلانات. وإن كنت تفضّل ألا تُستخدم أغنيتك بهذه الطريقة، فراسلنا بالبريد الإلكتروني ونستثنيها.

الكلمات التي قدّمتها

إن كتبت كلماتك بنفسك، فإنك تحتفظ بأي حقوق نشر لك فيها، وتمنحنا الترخيص الوارد في القسم 14 لاستخدامها في إنتاج أغنيتك وتسليمها، وفي الترويج لها ما لم تطلب استثناءها.

الأصوات في كتالوجنا مبنية على أصوات مطربين حقيقيين وافقوا كتابيًا على استخدام أصواتهم في أغاني Songlorious، ويتقاضون أجرًا على ذلك. ويشمل ترخيصك أغنيتك كما سُلّمت، ولا يمنحك أي حق في صوت المطرب أو اسمه أو صورته أو هويته. وتوافق على ألا تستخرج الصوت من أغنيتك أو تعزله أو تقلّده أو تستنسخه أو تدرّب أي نظام عليه، وألا توحي بأن المطرب يؤيدك أو يؤيد نشاطك أو أي شيء في الأغنية. وقد يظهر الاسم الفني للمطرب على صفحة أغنيتك وعلى منصات البث.

ما تعطينا إياه يبقى لك

القصة والأسماء والتفاصيل والصور والكلمات وأي شيء آخر تقدّمه («محتواك») يبقى ملكك. وأنت تؤكد أن لك الحق في إعطائه لنا، وأنه دقيق، وأن استخدامه كما هو موضّح هنا لن ينتهك حقوق أحد أو خصوصيته. وإن كانت أغنيتك عن شخص آخر، فأنت مسؤول عن الحصول على أي إذن تحتاج إليه لمشاركة تفاصيله معنا.

الترخيص الذي تمنحنا إياه

وأنت تمنح Songlorious ترخيصًا عالميًا ودائمًا وغير قابل للإلغاء ودون إتاوات وقابلًا للترخيص من الباطن، لاستخدام محتواك ونسخه وتكييفه وتحريره وترجمته لأغراض كتابة أغنيتك وإنتاجها وتسليمها وتعديلها وحفظها ودعمها؛ وتشغيل الموقع وعملية الإنتاج لدينا وتحسينهما؛ والترويج لـ Songlorious، مع مراعاة أي استثناء تطلبه وفق القسم 12. وإلى الحد الذي يسمح به القانون، تتنازل عن حقوقك المعنوية في محتواك وفي الأغنية.

شركاؤنا التقنيون يعالجون محتواك

يتضمن صنع أغنيتك مشاركة محتواك، ومنه كلماتك، مع مزوّدي خدمات خارجيين نعتمد عليهم في الإنتاج الموسيقي وأدوات الذكاء الاصطناعي والاستضافة والبريد الإلكتروني والرسائل والدفع والنشر على منصات البث والشحن. ويعالجه هؤلاء المزوّدون وفق شروطهم وسياسات الخصوصية الخاصة بهم، وقد تسمح لهم بالاحتفاظ به أو استخدامه لتشغيل خدماتهم وتحسينها. وبما أن Songlorious شركة أمريكية، تُحفظ بياناتك وتُعالَج في الولايات المتحدة. وبتقديمك الطلب فإنك تأذن بذلك.

الرجاء ألا تضمّن محتواك معلومات لا تريد أن تُعالَج بهذه الطريقة. تحتاج الأغنية إلى أسماء وقصص وذكريات، لا إلى أرقام هويات حكومية، أو بيانات مالية أو بنكية، أو معلومات طبية، أو عناوين تتجاوز ما يتطلبه الشحن، أو أي شيء آخر حساس. ويشرح ما يلي ما نجمعه وكيف نتعامل معه.

خصوصيتك

• ما نجمعه: اسمك، وبيانات التواصل معك (بريدك الإلكتروني ورقم جوالك)، والقصة والأسماء والتفاصيل التي تعطينا إياها لأغنيتك ومنها أي كلمات تكتبها، وحالة طلبك ودفعه، ومعلومات تقنية عن زيارتك مثل عنوان IP ونوع المتصفح والإعلان أو الصفحة التي أوصلتك إلينا. أما بيانات بطاقتك فتعالجها Wix Payments، ولا نحفظها كاملة لدينا.
• لماذا نجمعه: لنكتب أغنيتك وننتجها ونسلّمها، ولنرسل إليك تحديثات طلبك بالبريد الإلكتروني أو على واتساب، ولنعرف أيّ إعلاناتنا أوصلتك إلينا. ولا نرسل إليك عروضًا إلا إن وضعت علامة في خانة تلقّي العروض.
• أين نحفظه: تُحفظ بياناتك وتُعالَج في الولايات المتحدة.
• من يطّلع عليه: المطربون والمنتجون الذين يعملون على طلبك، ومزوّدو الخدمات الذين نعتمد عليهم في تشغيل الموقع والإنتاج والرسائل والدفع (كما في «شركاؤنا التقنيون يعالجون محتواك» أعلاه). وحين تشتري، نُبلغ منصات الإعلان (مثل Meta وGoogle وOpenAI) بالشراء ونرسل معه بريدك الإلكتروني، وقد نرسل رقم جوالك واسمك أيضًا، وكلها بصيغة مُرمَّزة لا تُظهرها كما هي، إضافةً إلى معلومات تقنية عن زيارتك. وأثناء تصفّحك صفحاتنا، تسجّل ملفات تعريف الارتباط وأدوات القياس معلومات عن زيارتك.
• نسخة من بياناتك أو حذفها: راسلنا على gloriousanswers@songlorious.com لتطلب نسخة من بياناتك أو حذفها. ونحتفظ بما يلزمنا القانون بالاحتفاظ به من سجلات الطلبات والمدفوعات.

وفي ما لا تذكره هذه الشروط عن خصوصيتك، تُطبَّق سياسة الخصوصية المنشورة على موقعنا.

يجوز لنا رفض أي طلب أو تعديله أو إلغاؤه إن كان محتواه مخالفًا للقانون، أو يحضّ على الكراهية، أو ينطوي على مضايقة أو تهديد، أو ذا طابع جنسي صريح، أو تشهيريًا، أو يستهدف فردًا من عامة الناس أو يفضح خصوصياته، أو يمجّد العنف أو إيذاء النفس، أو ينتهك حقوق أحد، أو ينتحل شخصية أحد، أو إن رأينا بحسن نية أنه لا يتفق مع قيمنا. وإن رفضناه قبل بدء العمل، نعيد لك المبلغ كاملًا. وإن ظهرت مشكلة لاحقًا، نعمل معك على تعديل المحتوى، وإن تعذّر ذلك يُطبَّق القسم 10.

البريد الإلكتروني هو وسيلتنا لإدارة طلبك: نرسل إلى العنوان المسجّل في حسابك كلمات أغنيتك للمراجعة، وأغنيتك عند تسليمها، وردودنا على طلبات التعديل، والإشعارات. وقد تصلك كلمات أغنيتك وتحديثات طلبك على واتساب أيضًا، على رقم الجوال المذكور في طلبك. وتوافق على أن البريد الإلكتروني يفي بأي اشتراط بأن نبلغك كتابيًا.

لا نرسل عروض Songlorious إلا لمن وضع علامة في خانة تلقّي العروض، ونرسلها بالبريد الإلكتروني أو على واتساب. والموافقة على العروض ليست شرطًا للشراء، ويمكنك سحبها في أي وقت. أما تحديثات طلبك فنرسلها بالبريد الإلكتروني أو على واتساب.

يمكنك أن تترك إكرامية اختيارية للمطرب الذي يظهر صوته في أغنيتك. والإكراميات طوعية، وتُعالَج عبر جهات الدفع نفسها التي تعالج الطلبات، ولا تُسترد. ويحصل المطرب على نصيبه من الإكراميات وفق اتفاقنا معه.

نمنحك ترخيصًا محدودًا وقابلًا للإلغاء وغير حصري لاستخدام الموقع للغرض المقصود منه. وتوافق على ألا:

Songlorious, LLC (“Songlorious”, “we”, “us”) operates www.songlorious.com and its related pages, accounts and services, including these Arabic pages (together, the “Site”). These Terms of Use, including what they say about your privacy (section 14), together with our FAQ (together, the “Terms”), are the agreement between you and us. By using the Site or placing an order, you accept them. If you don’t agree, please don’t use the Site.

Where the FAQ and these Terms describe the same thing differently, these Terms control.

These Terms govern orders placed on our Arabic pages. Where they don’t cover something, the English Terms of Use published on our site apply, to the extent they don’t conflict with these Terms.

We may update these Terms from time to time. The current version is always at www.songlorious.com/arabic/terms-arabic with its effective date at the top. Orders are governed by the Terms in effect when the order is placed. Continuing to use the Site after a change means you accept the updated Terms.

Songlorious is human-led, artist-driven and technology-assisted. When you order, you tell us the story, the people, the must-have details, the style, the mood and the voice you’d like. From there:

• Our Arabic team writes your lyrics from the details you give us, then sends them to you by email or WhatsApp to review before anything is recorded (section 6).
• Our producers create the music using professional production tools, which include AI-assisted music technology. Every song is directed, reviewed, edited and finished by a person.
• The voice on your song is based on a real singer from our artist catalog, who has agreed to work with us and is paid for it. Their voice is applied to your song through our production process (section 13).
• A producer mixes and masters the final recording by hand before it reaches you.

We don’t sell one-click AI output, and we don’t claim that the singer you chose personally sat in a studio and recorded your song. Both would be untrue, and this section exists so you know exactly what you’re buying.

You must be at least 18 to order. Your account is tied to the email address you order with; keep it accurate, because that is where we send your lyrics, your song and every notice about your order (we may also send your lyrics and order updates on WhatsApp). You are responsible for activity under your account.

We may decline or cancel any order, or close any account, where these Terms are breached or where we reasonably believe an order is fraudulent or abusive. If we decline an order before work has begun, we refund it in full.

What you give us

An order is the details you enter on the order page: your story, the people involved, your four must-have details, the occasion, the dialect and style, the mood, length, delivery speed and voice. We make the song from those details, so please make them accurate and complete. We are not responsible for a song that faithfully reflects details you gave us incorrectly.

Changing your details after ordering

After you order, you have a window to add to or change any of your details on your song page (the “Edit My Order” button). The window depends on the delivery speed you chose:

You can end the window early by confirming your details are final (the “These details are final — start my song” button), which starts your song sooner. Once the window closes, or you confirm, we begin writing and your details can no longer be changed. Your next opportunity to change anything is the lyrics review (section 6).

Delivery date

You choose your delivery date when you order. We deliver your song by 11:59 PM Eastern Time on that date (the next morning in the Gulf). Faster delivery carries the fees shown at checkout.

Prices and payment

Prices are shown at checkout in US dollars and include everything for the options you select. Any Saudi riyal amount we show beside them is approximate and for reference only; the amount charged is the US dollar amount. Payment is taken when you order (or, for Try Before You Buy, in two parts as described in section 7). Payments are processed by third-party payment providers under their own terms; we don’t store your full card details.

Lyrics we write for you

Our Arabic team writes your lyrics from your story, then sends them to you by email or WhatsApp to review and ask for any changes before recording. You may reword any line you like, as many lines as you like, at no cost. Each line needs to stay close to its original length so it still fits the melody, and if you change a line that repeats in the chorus we’ll ask whether to change it everywhere or only once.

Approving your lyrics is final. When you approve the lyrics, or when recording starts, the lyrics as they stand at that moment go to production exactly as written. They cannot be changed again before delivery. We send you the lyrics in time to deliver your song on schedule. If we don’t hear back from you before recording starts, we record the song with the lyrics we sent you.

Lyrics you write yourself

You may supply your own lyrics when you order, and we record your song with them as you wrote them. If you do, you confirm that you wrote them, that you own them, and that they don’t copy or adapt anyone else’s lyrics, melody or song. We can’t make cover songs, parodies or songs built on existing works, including re-recording a well-known zaffa or song with names added. We may decline or edit submitted lyrics that appear to infringe someone else’s rights, exceed what fits the song length (2 minutes 1,800, 3 minutes 2,400, 4 minutes 3,000, 5 minutes 3,600, 6 minutes 4,200 characters, counting spaces and line breaks; song durations are approximate), or breach section 15. Lyrics you supply remain yours; you license them to us as described in section 14.

With Try Before You Buy you pay 50% of the song price when you order. We make your entire song. When it’s ready you get the full lyrics and a sample of roughly 30 seconds on your song page. You can then unlock the complete song by paying the remaining balance.

• The initial payment is not refundable. It pays for the writing and production that has already been done.
• If something about your sample doesn’t match what you ordered, use the “Something’s wrong with this song” option on your song page. We fix it free, and you don’t need to pay the balance first.
• If you’d simply like something different, that’s a revision (section 9): approve your song, pay the balance, and request it within 72 hours of the full song being delivered.
• Add-ons purchased with a Try Before You Buy order are fulfilled after the balance is paid.

Your song is delivered to your song page on the Site, with an email to let you know. There you can listen, read the lyrics and download your song as an MP3 file as many times as you like. We intend to keep your song page available, but we recommend downloading and keeping your own copy; we don’t guarantee that any file will remain hosted indefinitely.

The editable project files behind your song are large and are not kept for long after delivery. This is why revisions have a deadline (section 9).

What we promise

Every song we deliver will:

• be a good-quality recording (no glitches, cut-ins or cut-outs, accidental distortion, or a song that is too quiet);
• meet the length you ordered;
• have vocals that are on key;
• contain your four must-have details and reflect your story accurately, as you wrote them in your order and as you approved them in the lyrics review.

Free fixes

If your song doesn’t meet the promise above, that’s our mistake. Tell us within 72 hours of delivery using the revision request on your song page and we fix it at no charge. For Try Before You Buy orders the 72 hours run from when you pay the balance and the full song is delivered; sample problems are handled under section 7.

Everything else is a revision

Any other change after delivery is a revision: a different feel, tempo, arrangement or instrumentation; different wording from the lyrics you approved; a different voice; or anything based on taste rather than on what was ordered. Revisions carry a fee that depends on the work involved. We review your request, tell you the cost before doing anything, and invoice it separately. There is no free allowance for “small” changes, because even a few words mean re-producing the song.

Revision requests must be made within 72 hours of delivery. After that we may not be able to make changes at all, because project files are not retained (section 8). Revisions to a song that has already been distributed to streaming platforms don’t include re-distribution; see section 11.

Every song is custom made for you and can’t be reused for anyone else, so we don’t offer refunds once work has begun.

• Cancelling a full-price order: you may cancel within 24 hours of placing it. We refund the price less a 35% service and processing fee.
• Try Before You Buy: the initial payment is not refundable (section 7).
• Orders we decline before work begins are refunded in full (section 4).

Music is personal, and sometimes a song that meets every promise still isn’t what you hoped for. We handle those situations case by case; please talk to us.

Commercial License

Your standard song license is for personal use (section 12). A Commercial License is required if you are buying the song for a brand or business, will use it to promote one, will play or perform it at a public or business event, or will post it on a business, brand or influencer account. Brands include personal brands and non-profits. If a song’s content shows that it needs a Commercial License that wasn’t purchased, we’ll invoice you for it and pause the order until it’s paid. Using a song beyond personal use without a Commercial License breaches these Terms.

Streaming

With the Streaming add-on we distribute your song to major streaming platforms, usually within about 10 days of delivery, under the artist’s name. We control the metadata, artwork, release and any later removal, and platforms in some countries may not carry it. Songlorious keeps any streaming revenue; you receive no royalties. Streaming makes your song public, so you shouldn’t choose it for a song containing details you’d prefer to keep private.

Your license

When your song is delivered and paid for in full, we grant you a perpetual, worldwide, royalty-free, non-exclusive license to play, download, copy for your own use, and share your song for personal, non-commercial purposes: listening privately, sharing with friends and family, posting on personal (non-business) social media, and playing at private, unbranded events such as a wedding or birthday. You may not sell, license, sublicense, rent or distribute the song, use it to promote anything, or use it in any commercial or public setting without a Commercial License.

A Commercial License extends that license to commercial and public uses of the song as delivered. It doesn’t include the right to resell the song itself, to register it as your own musical work, or to remove or alter the artist’s credit where one appears.

What we keep, and what we can honestly promise

Songlorious retains ownership of the sound recording and of all rights in the song other than those licensed to you above and any lyrics you supplied yourself. We license to you only the rights we actually hold.

Because our production process uses AI-assisted music technology, some musical elements of your song may not be eligible for copyright protection under current law, and we make no promise that the melody, arrangement or recording is registrable, unique, or free of resemblance to other music. What we do promise is that the lyrics were written for you, the song was produced for you, and no other customer receives your song.

Songlorious may use your song, and excerpts of it, to promote Songlorious and our artists, for example as a sample song or in advertising. If you’d prefer your song not be used that way, email us and we’ll exclude it.

Lyrics you supplied

If you wrote your own lyrics, you keep whatever copyright you have in them. You grant us the license in section 14 to use them in producing, delivering and, subject to any opt-out, promoting your song.

The voices in our catalog are based on real singers who have agreed, in writing, to have their voice used in Songlorious songs, and who are paid for it. Your license covers your song as delivered. It gives you no rights in the artist’s voice, name, likeness or identity. You agree not to extract, isolate, imitate, clone, or train any system on the voice from your song, and not to suggest that the artist endorses you, your business, or anything in the song. The artist’s stage name may appear as a credit on your song page and on streaming platforms.

What you give us stays yours

The story, names, details, photos, lyrics and anything else you submit (“Your Content”) remain yours. You confirm that you have the right to give it to us, that it’s accurate, and that using it as described here won’t infringe anyone’s rights or invade anyone’s privacy. If your song is about someone else, you’re responsible for having whatever permission you need to share their details with us.

The license you give us

You grant Songlorious a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, adapt, edit and translate Your Content for the purposes of writing, producing, delivering, revising, storing and supporting your song; operating and improving the Site and our production process; and, subject to any opt-out under section 12, promoting Songlorious. To the extent permitted by law you waive moral rights in Your Content and in the song.

Technology partners process your content

Making your song involves sharing Your Content, including your lyrics, with third-party service providers we use for music production, AI-assisted tools, hosting, email, messaging, payments, streaming distribution and shipping. Those providers process it under their own terms and privacy policies, which may permit them to retain it or use it to operate and improve their services. Because Songlorious is an American company, your data is stored and processed in the United States. By ordering you authorize this.

Please don’t include information you wouldn’t want processed this way. A song needs names, stories and memories, not government ID numbers, financial or account details, medical information, addresses beyond what shipping requires, or anything else sensitive. What follows describes what we collect and how it’s handled.

Your privacy

• What we collect: your name, your contact details (your email address and mobile number), the story, names and details you give us for your song, including any lyrics you write, the status of your order and payment, and technical information about your visit such as your IP address, browser type and the ad or page that brought you to us. Your card details are handled by Wix Payments, and we don’t store them in full.
• Why we collect it: to write, produce and deliver your song, to send you order updates by email or WhatsApp, and to know which of our ads brought you to us. We only send you offers if you ticked the box to receive them.
• Where we keep it: your data is stored and processed in the United States.
• Who sees it: the singers and producers working on your order, and the service providers we rely on to run the Site, production, messages and payments (as in “Technology partners process your content” above). When you buy, we report the purchase to ad platforms (such as Meta, Google and OpenAI) and send your email address with it, and we may send your mobile number and name too, all in hashed (scrambled) form, never as plain text, along with technical information about your visit. While you browse our pages, cookies and measurement tools record information about your visit.
• A copy of your data, or deleting it: email us at gloriousanswers@songlorious.com to ask for a copy of your data or for its deletion. We keep the order and payment records the law requires us to keep.

Where these Terms don’t cover your privacy, the Privacy Policy published on our site applies.

We may decline, edit or cancel any order whose content is unlawful, hateful, harassing, threatening, sexually explicit, defamatory, or that targets or exposes a private individual, glorifies violence or self-harm, infringes anyone’s rights, impersonates someone, or that we judge in good faith to be inconsistent with our values. Where we decline before work starts, you receive a full refund. Where an issue is found later, we’ll work with you to adjust the content; if that isn’t possible, section 10 applies.

Email is how we run your order: lyrics for review, delivery, revision replies and notices all go to the address on your account. Your lyrics and order updates may also reach you on WhatsApp, at the mobile number on your order. You agree that email satisfies any requirement that we notify you in writing.

We only send Songlorious offers to people who ticked the box to receive them, by email or WhatsApp. Agreeing to receive offers isn’t a condition of purchase, and you can withdraw it at any time. Order updates are sent by email or WhatsApp.

You may leave an optional tip for the artist whose voice features on your song. Tips are voluntary, processed with the same payment providers as orders, and not refundable. Tips are shared with the artist under our agreement with them.

We grant you a limited, revocable, non-exclusive license to use the Site for its intended purpose. You agree not to:

• submit information that is false, infringing, unlawful or abusive, or impersonate anyone;
• access or attempt to access another person’s account, order or song;
• bypass, probe or interfere with the Site’s security or any technical limit;
• use bots, scrapers, automated scripts or similar tools to access the Site, submit forms, or extract content;
• copy, reproduce, resell, frame or commercially exploit the Site or its content beyond what these Terms allow;
• reverse engineer or decompile any part of the Site.

We may limit, suspend or terminate access to the Site at our discretion, including for breach of these Terms.

The Site, its design, code, text, artwork, sample songs, trademarks and logos are owned by Songlorious or our licensors and are protected by law. Nothing in these Terms transfers any of it to you beyond the licenses expressly granted.

We respect intellectual property and respond to notices under the Digital Millennium Copyright Act, 17 U.S.C. §512. If you believe material on the Site infringes your copyright, send a written notice to our designated agent:

Your notice must include: a physical or electronic signature of a person authorized to act for the copyright owner; identification of the copyrighted work; identification of the allegedly infringing material and where it is on the Site; your contact information; a statement that you believe in good faith the use isn’t authorized by the owner, its agent or the law; and a statement, under penalty of perjury, that the notice is accurate and you are authorized to act for the owner.

On receiving a complete notice we will remove or disable the material, forward the notice to the person who posted it, and notify them. That person may send a counter-notice containing their signature, identification of the removed material and its former location, a statement under penalty of perjury that they believe it was removed by mistake or misidentification, and their name, address, phone number and consent to the jurisdiction of the federal court for their district (or, outside the US, any district where Songlorious may be found) and to accept service from the complaining party. We will forward a counter-notice to the complaining party and may restore the material in 10 to 14 business days unless we’re told a court action has been filed. This process is only for copyright complaints.

Except for the quality promise in section 9, the Site, its content and our services are provided “as is” and “as available”. To the fullest extent permitted by law, Songlorious disclaims all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Site will be uninterrupted, secure or error-free, or that any song will meet expectations of taste or artistic preference. Some states don’t allow these limitations, in which case they apply to you only to the extent permitted.

To the fullest extent permitted by law, Songlorious and its owners, employees, contractors, artists and partners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from the Site, a song or these Terms, even if advised of the possibility. Our total liability for any claim relating to an order is limited to the amount you paid Songlorious for that order. Some states don’t allow these limitations, in which case they apply to you only to the extent permitted.

You agree to defend, indemnify and hold harmless Songlorious and its owners, employees, contractors, artists and partners from any claim, loss, or expense (including reasonable attorneys’ fees) arising from Your Content, your use of a song beyond the license granted, or your breach of these Terms.

• Entire agreement. These Terms (including what they say about your privacy) and the FAQ, together with the English Terms of Use and the Privacy Policy published on our site for anything these Terms don’t cover (sections 1 and 14), are the whole agreement between us about the Site and your orders.
• Severability. If any part of these Terms is unenforceable, the rest remains in effect.
• Assignment. You may not assign these Terms or your song license, except that you may give the song as a gift for the recipient’s personal use under the same license. We may assign these Terms without restriction.
• Waiver. Not enforcing a term isn’t a waiver of it.
• Force majeure. We aren’t liable for delay or failure caused by events beyond our reasonable control, including outages of the third-party services we depend on.
• Third-party sites. Links to other sites are for convenience; we aren’t responsible for their content or practices.
• Survival. Sections 12 through 14 and 19 through 25 survive the end of any order or account.

These Terms and any dispute between us are governed by the laws of the State of Ohio, United States, without regard to conflict-of-law rules. Any action arising from these Terms or the Site must be brought in the state or federal courts serving Hamilton County, Ohio, and you consent to their exclusive jurisdiction. Before filing, please contact us; most concerns are resolved by talking.
